Client Challenge:
Our client, a technology company holding a patent related to wireless communication, approached us to assess the potential for infringement in the emerging WiFi 7 standard. They sought our expertise to determine if their patent could be leveraged to assert infringement claims against WiFi 7 implementers.
Approach and Obstacles:
We began by analysing the client’s patent and comparing it against the existing WiFi 6 standard. However, we found no significant overlap between the patent claims and WiFi 6 specifications.
As we delved into the WiFi 7 domain, we encountered a need for complete and standardized documentation. The client provided a draft specification document for IEEE 802.11 BE (WiFi 7), but it contained missing clauses and needed to be more comprehensive. Later, they shared an amendment to supplement the initial draft.
To better understand the WiFi 7 protocol, we thoroughly examined the IEEE 802.11 specifications from 2020 and 2021. However, these documents offered limited guidance specific to WiFi 7.
Overcoming Challenges:
Without definitive reference books on WiFi 7, we adopted a proactive approach. We extensively reviewed the specifications filed by major industry players such as Canon and Qualcomm, who were part of the IEEE task group responsible for defining the WiFi 7 standard.
Mapping the client’s patent claims to the WiFi 7 domain proved complex and time-consuming. We meticulously analysed 400-500 documents to comprehensively understand the technology landscape.
Infringement Discovery:
Our in-depth analysis identified potential infringement of the client’s patent within the WiFi 7 standard, specifically related to multi-link operation. This finding allowed the client to assert their intellectual property rights against WiFi 7 implementers.
Outcome and Impact:
Armed with our findings and guidance, the client is raising funds to file an infringement suit. Our work identified the potential for infringement and provided valuable insights on how to approach legal action.
Furthermore, we offered strategic guidance to the client regarding the future direction of wireless technology, including the potential evolution towards WiFi 8. This foresight empowers clients to proactively position their patent portfolio for ongoing relevance and value.
